Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern the relationship between "YOLUTAP" MMC (VÖEN 1309994231, the "Provider") and the user of the Yolutap service (the "User"). By registering an account, using yolutap.com, or paying for the Services, the User expresses full and unconditional acceptance of these Terms. If you do not agree, do not use the service.

2. Who may use the service

The Service is intended for individuals aged 10 to 22.

If the User is under 18, this Agreement is entered into and the Service is paid for by the User's parent or legal guardian, acting on behalf of and with the consent of the minor and assuming responsibility for use of the Service.
If the User is 18 or older, they enter into the Agreement and pay for the Service themselves and are responsible for its use.

3. What Yolutap is (nature of the service)

Yolutap is an AI-based career-orientation test that produces a personalized report. The report is informational and advisory: it is a guide, not professional psychological or career counseling, not a diagnosis, and not a substitute for an in-person consultation with a specialist.

4. Accuracy of data

The User undertakes to provide accurate data (age, email). The User is responsible for the correctness of test answers.

5. Payment and refunds

Payment is a one-time charge (100% prepayment), with no subscription or automatic billing.

By paying for the Service, the User consents to the immediate commencement of its provision (generation of the report) and confirms awareness of the refund conditions applicable to digital content.

A refund is available before report generation begins (e.g., if payment was made but the test has not yet been completed). Once the report has been generated and sent to the provided email or made available in the account, the Service is deemed fully rendered and the payment is non-refundable.

Exception: if the report was not generated or delivered due to a technical issue on the Provider's side, the Provider will resolve the issue or refund the payment.

Premium plan: the cost of the coaching session may be refunded, or the session rescheduled, provided the request is sent no later than 24 hours before the agreed time; if this deadline is missed, the cost of the session is retained. The cost of the report is non-refundable once generated.

6. Acceptable use

Prohibited: interfering with the Service; using bots or automation to bypass protections; copying, reselling, or publishing the Service's content.

7. Intellectual property

Exclusive rights to the Service — the "Yolutap" trademark, software code, algorithms, test structure, methodology, report design and texts, and trilingual localization — belong to "YOLUTAP" MMC (VÖEN 1309994231). The User is granted a limited, non-exclusive, non-transferable license to use the received report solely for personal, non-commercial purposes. Copying, decompiling, distributing, or publishing the Service's materials without the rights holder's written consent is prohibited.

The methodology partly uses open O*NET data (U.S. Department of Labor / O*NET) under the Creative Commons Attribution 4.0 license; rights to Yolutap's original methodology, matching system, and implementation belong to the Provider.

8. Personal data

Processing of Users' personal data is carried out in accordance with the Privacy Policy. By accepting these Terms, the legal guardian of a minor (or an adult User) consents to the processing of personal data, including the storage of anonymized test results for the purpose of improving the methodology.

9. AI disclaimer

The report is generated with the involvement of artificial intelligence and may contain inaccuracies. It is a guide for reflection and discussion, not a final conclusion.

10. Disclaimer of warranties

The Service is provided "as is," without warranty of uninterrupted or error-free operation.

11. Limitation of liability

To the maximum extent permitted by applicable law, the Provider's total aggregate liability for any claims related to use of the Service is limited to the amount actually paid by the User for the relevant Service. The Provider is not liable for lost profits, indirect damages, or decisions made by the User or their legal guardians based on the report's recommendations.

12. Force majeure

The parties are not liable for failure to perform obligations due to force majeure, including failures, outages, or restrictions by third-party providers of AI, infrastructure, hosting, and communications.

13. Changes to the Terms

The Provider may update these Terms. The current version is posted at a permanent address on the site; the effective date is shown at the top of the document.

14. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Azerbaijan. The parties shall seek to resolve disputes through negotiation; the period for reviewing a claim is 15 (fifteen) calendar days. Failing agreement, disputes shall be resolved in the competent courts of the city of Baku, Republic of Azerbaijan.
